The pantomine season will be long gone when this article is published but the spirit of panto tends to live on year long in the construction industry. So, on the (nearly) topical subject of "Oh yes he did - Oh no he didn't", it appears to me that repudiation seems to be making a comeback in both Adjudication and in the courts with panto-esque rumblings.
Global Pain or Global Gain? Or The first consideration of John Doyle -v- Laing in the English Courts
Everyone reading this article will be familiar with the term "global claim", also called "rolled up", "total cost" or "total loss" claim. It most frequently describes a contractor's claim for time and/or money resulting from delays caused by a number of different events for which the contractor says the employer is liable.
